Service of Process

The Sheriff’s Office is mandated to serve all papers directed to it by the Courts or private litigants and files returns with the courts. The Sheriff and appointed deputies serve over 100,000 court papers annually. These documents include summonses, court process, court ordered attachments and evictions and other related papers. The deputies are supported by an administrative staff who maintain the tracking process in the Sheriff’s summons component in the Criminal Justice Information System and perform related clerical duties.

The current fee for service of process are as follows:
(Checks should be made payable to the Montgomery County Sheriff’s Office)

  • $5.00 for Maryland District Court Landlord and Tenant Notices
  • $40.00 for Maryland Process
  • $60.00 for out of state process
  • There are no fees for service of Domestic Violence related process.

Note: Out of State Papers – At least one copy of the summons and complaint with a cover letter that describes any specific restrictions on service or other pertinent information. Also include location of person to be served and any other available information.

The Sheriff's Office is first Sheriff's Office in the State of Maryland to be accredited by the Commission on Accreditation for Law Enforcement Agencies. The Sheriff's Office received its initial accreditation in November of 1995 and underwent successful on site re-evaluations in 2000, 2003, and 2006, 2009 and most recently in 2012. In order to receive and maintain accreditation, the Sheriff's Office has to demonstrate voluntarily that they meet over 4 6 0 professionally recognized standards for excellence in management and service delivery.
